Is Most of Your Close Family in Australia? Understanding the Remaining Relative Visa 835

0
231

Having your closest family members living permanently in Australia while you remain separated from them overseas or on a temporary visa can create a difficult long-term situation.

Australia has an Other Family visa pathway known as the Remaining Relative Visa Subclass 835, which may allow an eligible person to obtain permanent residence where their qualifying close family relationships meet strict requirements.

But this visa is frequently misunderstood.

Having “most” of your family in Australia is not necessarily enough. Eligibility can depend on your complete family structure, including relatives connected to your spouse or de facto partner.

What Is the Remaining Relative Visa Subclass 835?

Subclass 835 is a permanent onshore Australian visa.

It is designed around applicants whose relevant close family circumstances satisfy the Remaining Relative requirements and who have an appropriate qualifying relative in Australia.

If granted, the visa provides Australian permanent residence.

Unlike some migration pathways, there is no general age limit for the primary applicant.

However, the family test is highly specific.

Who Can Be the Qualifying Relative?

The qualifying Australian relative will generally need to have an eligible relationship with the applicant.

This can include a:

  • Parent

  • Brother or sister

  • Step-brother

  • Step-sister

The qualifying relative generally also needs to be settled and usually resident in Australia with an appropriate Australian immigration status.

This is why Subclass 835 should not simply be treated as another general family-reunion visa.

Your Entire Family Structure Matters

This is the part applicants often underestimate.

Home Affairs does not necessarily look only at the applicant and the person sponsoring them.

Other near relatives can affect eligibility.

Depending on the circumstances, this can involve:

  • Parents

  • Brothers and sisters

  • Step-siblings

  • Certain children and stepchildren

  • Your spouse or de facto partner's parents

  • Your spouse or de facto partner's siblings

This means a single relative living overseas can potentially become highly relevant.

For a detailed explanation of how the family test, sponsorship and onshore requirements work, review Think Higher Consultants' guide to the Remaining Relative Visa Subclass 835.

Your Partner's Family Can Change the Result

A particularly important feature of this pathway is that having a spouse or de facto partner can change the family assessment.

Imagine that you have only one sibling, and that sibling is permanently settled in Australia.

At first glance, your situation might appear straightforward.

But if you have a partner whose relevant parent or sibling lives overseas, that family relationship may also need to be considered.

This is why applicants should map both sides of the family before assuming they qualify.

Can Your Child Sponsor You?

Not simply because your child happens to be your only close relative in Australia.

The qualifying-relative requirements for Subclass 835 are more specific.

The visa should therefore not be treated as a substitute for a Parent visa merely because an applicant has an Australian citizen or permanent resident child.

The exact family relationship needs to fit the Remaining Relative framework.

Who Can Sponsor the Application?

The qualifying relative may generally act as sponsor where they satisfy requirements relating to age, Australian status and settlement.

In some circumstances, the qualifying relative's spouse or de facto partner may be able to sponsor.

Previous sponsorship history can also matter.

This means applicants should not assume that an otherwise eligible Australian relative can automatically sponsor another Remaining Relative application.

The sponsor's history needs to be checked.

Why Your Current Australian Visa Matters

Subclass 835 is an onshore pathway.

But simply being physically present in Australia does not automatically mean you can lodge a valid application.

Your current and previous immigration circumstances can matter.

Issues may include:

  • Your current visa

  • Previous visa expiry

  • Previous refusals

  • Visa cancellations

  • Restrictions on making another visa application

  • Other relevant immigration history

This should be checked before an application is prepared.

What About a Bridging Visa?

A bridging visa can become relevant after a valid onshore application where the applicant's existing visa expires before the Remaining Relative application is decided.

However, applicants should not make assumptions about work or travel rights.

Bridging visa conditions can differ.

The conditions of the actual visa granted need to be checked individually.

This is particularly important for an application that may remain unresolved for many years.

The Processing Queue Is Extremely Long

Remaining Relative visas are capped and queued.

That means even an applicant who satisfies the relevant criteria should not expect a quick permanent residence decision.

Eligible applications can receive a queue date and then wait for places to become available under the Other Family visa program.

Current estimates for new applications are measured in decades rather than months or a few years.

This makes long-term planning essential.

Eligibility Must Continue While You Wait

This is one of the biggest risks applicants need to understand.

Passing the Remaining Relative test when you lodge does not necessarily freeze your circumstances forever.

The relevant requirements may still need to be satisfied when Home Affairs eventually decides the application.

Over a very long processing period, a lot can change.

What Changes Could Affect Eligibility?

Potentially significant changes can include:

  • Marriage

  • Beginning a de facto relationship

  • Changes in your partner's family

  • Having a child

  • A relative moving to another country

  • A relative obtaining a different immigration status

For a visa where processing may span decades, these are not theoretical possibilities.

Your family structure can genuinely look very different by the time final assessment occurs.

What Evidence May Be Required?

Family evidence is central to Subclass 835.

Applicants may need documents establishing the complete family picture, such as:

  • Birth certificates

  • Marriage records

  • Relationship documents

  • Adoption records where relevant

  • Evidence relating to parents

  • Evidence relating to siblings and step-siblings

  • Evidence relating to relevant children

  • Documents showing where relatives live

  • Australian citizenship or permanent residence evidence

  • Sponsor identity and status documents

The objective is not merely to establish the applicant's relationship with the sponsor.

The evidence needs to help establish the wider family structure.

Assurance of Support

An accepted Assurance of Support is generally required before the visa can be granted.

This is separate from visa sponsorship.

The assurer needs to satisfy the applicable financial requirements.

Because this requirement generally arises later in the process, applicants should understand it as part of their long-term planning rather than assuming the sponsorship itself covers every financial obligation.

How Is the Application Lodged?

Subclass 835 uses a paper application process.

Broadly, applicants need to:

Map the complete family structure.

Identify relevant relatives for both the applicant and any spouse or de facto partner.

Confirm the qualifying relative and sponsor.

Check their relationship, residence, immigration status and sponsorship history.

Review the applicant's onshore visa position.

Determine whether a valid application can be made from Australia.

Prepare and lodge the application.

Complete the applicable forms and submit the supporting family evidence.

Enter queue processing where eligible.

Further health, character, Assurance of Support and updated evidence may be requested later.

For this visa, the family assessment should come before the paperwork.

What Happens After Grant?

Subclass 835 provides Australian permanent residence.

Once granted, the holder can remain in Australia indefinitely.

An initial travel facility also applies for a specified period.

The expiry of that travel facility does not itself mean permanent residence has ended, although appropriate arrangements may be required for future international travel.

Common Mistakes With Remaining Relative Visa 835

The biggest mistake is oversimplifying the family test.

Statements such as “my whole family is in Australia” are not enough without examining exactly who counts under the visa requirements.

Another mistake is ignoring a spouse or partner's relatives.

Applicants can also assume that an Australian child automatically creates eligibility or that being physically present in Australia guarantees they can lodge an onshore application.

None of those assumptions should replace a proper family and visa-status assessment.

Questions to Ask Before Applying

Before pursuing Subclass 835, map the situation carefully:

Who are all of my relevant near relatives?

Where does each person normally live?

What immigration status does each relative hold?

Do I have a spouse or de facto partner?

Who are my partner's relevant relatives?

Do I have an eligible qualifying relative in Australia?

Can that person sponsor me?

Does my current Australian visa allow me to lodge a valid application?

Could my family circumstances realistically change during a very long queue?

If these questions have not been answered, it is too early to assume Subclass 835 is available.

Final Thoughts

Remaining Relative Visa Subclass 835 is unusual because eligibility depends heavily on the applicant's entire family picture.

One overlooked sibling, parent, step-relative or partner's family member can potentially change the assessment.

The long processing queue makes this even more important because family circumstances are not necessarily frozen on the day the application is lodged.

Before thinking about forms, fees or documents, map the complete family structure.

For this visa, that is where the real eligibility assessment begins.
