However, he met his partner, Sofia, a non-EU citizen from Brazil, in 2021. They fell in love and got married in 2022. Sofia now wants to join her husband in the UK.

The Analysis: Despite Daniel's identical immigration status, their story falls on the "new" side of the dividing line. Because their marriage took place after 31 December 2020, Sofia is not eligible for the EUSS Family Permit.

Their Pathway: The UK Spouse Visa.

1. Sofia cannot use the EU route. She must apply for a standard UK Spouse Visa under Appendix FM of the Immigration Rules—the exact same route that the partner of a British citizen must use.

2. This means Daniel must act as her financial sponsor and prove he meets the UK's strict minimum income requirement. They must provide a substantial and complex portfolio of financial evidence.

3. Sofia must also pass an approved English language test at the required level.

Their journey is much more complex, expensive, and subject to a far higher level of evidential scrutiny than Maria and Liam's.
