Online Piracy Bill: Lawmakers Split Over Anti-Piracy Act

The music and entertainment industry's hopes for a quick legislative fix to combat online piracy may be far from reality, as deep disagreements among U.S. lawmakers continue to cloud the future of a proposed bill.

During a recent session of the House subcommittee on courts, the internet and intellectual property, tensions ran high as members debated the peer-to-peer piracy prevention act, put forward by Representative Howard Berman of California. The bill, introduced in the latter part of the summer, seeks to provide a legal "safe harbor" to entertainment corporations that deploy technological countermeasures against the unauthorized distribution of their copyrighted content across file-sharing platforms such as Kazaa and Morpheus.

Among the techniques being explored are "spoofing," which involves inserting fake files into peer-to-peer networks, and the far more contentious "interdiction," a method that floods a heavy file-swapper's system with requests, effectively shutting out others from accessing the content.

Supporters of the bill argue that such measures are critical, particularly given that several of the most-used file-sharing platforms have set up operations overseas to sidestep legal accountability.

However, the proposal has not been without controversy.

Critics, including Representative Rick Boucher of Virginia, raised serious concerns about the potential for abuse. He highlighted an incident in which a company working on behalf of Warner Bros. flagged a file titled "Harry Potter" on a user's computer, only to discover it was a student's book report and not a pirated film. Despite this, efforts were still made to have the user's internet account suspended.

Consumer advocacy organizations have similarly pushed back. Gigi Sohn of Public Knowledge argued that the bill effectively transfers the burden and consequences of enforcement away from content creators and corporations, placing them instead on ordinary internet users.

Berman, however, defended the legislation, maintaining that it includes robust consumer protections and pointing out that users who connect to file-sharing networks voluntarily expose their personal data to the broader public.

Hilary Rosen of the Recording Industry Association of America, who appeared before the subcommittee, echoed this sentiment, stating that the entertainment industry already operates under stricter oversight than peer-to-peer users themselves. She emphasized the need for flexibility in adapting anti-piracy tools as technology continues to evolve, noting that every protective measure is quickly met with a workaround.

Absent from the hearing, peer-to-peer network representatives voiced their displeasure separately.

Steve Griffin of Morpheus held his own press gathering following the subcommittee session, criticizing the exclusion of peer-to-peer networks from the discussion and rejecting the notion that platforms like his should bear responsibility for how users choose to share files.

"Decentralized peer-to-peer technologies like Morpheus exist simply to connect people," Griffin said. "The network itself is formed by its users, not by us."

With such stark divisions remaining, the bill is widely expected to remain stalled in committee well into the following year, and even its eventual passage would likely require significant revisions to address the competing interests of consumers and rights holders alike.
